26. Statute relating to Reservation of Posts of Officers and Non-Teaching Staff of the University and Colleges [No. BSU-40/81-723 G.S. (1) dated 27.3.1982]

1. Reservation of posts.— The quota for reservation of posts for different categories of persons belonging to Scheduled Castes, Scheduled Tribes, Backward Classes, Women, Economically Backward Classes and Extremely Backward Classes shall be as follows :—

(a)       Scheduled Castes                                         ...  …               14%

Note .—Definitions of the aforesaid categories, for the purpose of 'reservation' shall be in accordance with resolutions Nos. 755, 756 and 757 dated 10.11.78 of the Department of Personnel & A.R. of Government of Bihar.

2. For the purpose of reservation of posts for different categories of persons according to the quota prescribed above, the University Office and its allied offices shall be treated as one unit, all post-graduate departments taken together shall be treated as a separate unit and each college (constituent or affiliated) shall be treated as a separate unit and the roster for reservation of posts unit-wise as above, shall be treated as a separate unit and the roster for reservation of posts unit-wise as above, shall apply to different categories of posts by grouping them together as under :-

Group (i)        All posts of officers other than that of the Registrar, the lnspector of Colleges, Finance Officer, the Controller of Examinations and such posts in which the number is not more than one;

Group (ii)      All posts of Class III employees; and

Group (iii)     All posts of Class IV employees.

3. These reservations shall apply only in the cases of direct recruitments; provided that in case of candidates belonging to Scheduled Castes and Scheduled tribes, the reservation shall also apply in cases of promotions as applicable in the State Government service.

4. In order to ensure appointments to different categories of posts according to the prescribed reservation the following procedure shall be observed:-

 (i) Whenever a vacancy occurs a new post is created in any of the groups and if it is decided to fill up the said vacancy or post by direct recruitment, an entry of the same shall be made in a register to be maintained unitwise, and group-wise in serial order under the signature of the Registrar or the Principal of the college, as the case may be.

(ii) Reservation of posts to the extent prescribed for each category shall be made unit-wise and groupwise by taking into account the total number of vacant posts in a particular unit and group.

(iii) The advertisement of posts shall indicate the reservations in favour of Scheduled Castes, Scheduled Tribes, Backward Classes, Women, Economically Backward Classes and Extremely Backward Classes candidates who are considered fit. On receipt of applications all candidates belonging to Scheduled Castes, Scheduled Tribes, Backward Classes, Women, Economically Backward Classes and Extremely Backward Classes who possess the requisite qualifications prescribed for the post shall be invited and interviewed separately in the first instance. The candidates belonging to the general category shall then be interviewed.

(iv) Panels of names of suitable candidates of each class for whom reservation is made shall be prepared unit-wise separately for each category (i.e. Scheduled Castes and Scheduled Tribes etc.) in order of preference. The panel in the general category shall include the persons of all categories including Scheduled Castes, Scheduled Tribes, Backward Classes, Women, Economically Backward Classes and Extremely Backward Classes in order of preference.

(v) Roster for reservation for each lot of one hundred posts shall be as follows :—

(a)       Vacancies against serial numbers 2, 8, 15, 22, 29, 36, 44, 52, 58, 65, 72, 79, 86 and 94 shall be reserved for Scheduled Castes.

(b)       Vacancies in serial numbers 4, 13, 23, 33, 43, 54, 63, 73, 83 and

93 for Scheduled Tribes.

(c)       Vacancies in serial numbers 6, 14, 30, 35, 45, 59, 70 and 80 for Backward Classes.

(d)       Vacancies in serial numbers 21, 42 and 85 for Women.

(e)       Vacancies in serial numbers 20, 41 and 84 for Economically Backward Classes.

(f)        Vacancies in serial numbers 3, 12, 25, 34, 51, 55, 61, 66, 75, 87, 95 and 100 for Extremely Backward Classes and the remaining vacancies shall be of the general category.

(vi)      In making appointments, it shall be ensured that persons belonging to reserved categories are appointed to the extent of the quota of reservation prescribed for the respective categories and in accordance with the given roster:

Provided that if sufficient number of candidates suitable in all respects for appointment to the reserved quota of vacancies are not available from the communities for whom reservations have been made in a particular year, such vacancies will be treated as carried forward vacancies and added as additional quota to the number that would be reserved in the following year in the normal course and to the extent to which approved candidates are not available in that year against this additional quota, a corresponding addition should be made to the number of reserved vacancies in the second following year.

(vii) The panel of selected candidates for appointment in different subjects shall lapse at end of each academic year but the preparation of list of vacancies according to the given order shall be continuous process.

5. Any other provision of the statute for reservation of posts for any of the above categories of employees which was in force immediately before the implementation of these statutes shall be deemed to have been deleted.
