12. Statute regarding Regularisation of Services of Purely Temporary Lecturers [No. 5240 G.S. (1) dated 18.11.1980]

Vide No. 5240 G.S.(I) dated 18.11.1980.

With effect from the date (14.11.1980) of the order of the Chancellor under Section 5(2) of the Bihar Inter University Board (1980) the undermentioned criteria shall be followed for absorption of purely temporary lecturers in the regular service of the University or of a college admitted to the University (other than a college managed and maintained by the State Govt).

1. A purely temporary lecturer who is in the service of the University or of a college admitted to it as a lecturer shall be appointed by the Syndicate or the Governing Body, as the case may be, in the regular service of the University or the college concerned, if he fulfils the following conditions:-

(a)       he is in the service of the Univercity or the college concerned as a lecturer on the date of implementation of these criteria;

(b)       he has completed or will complete a total period of at least 24 months of
service as a lecturer on 31-12-1980 in the University or in the

colleges where he is working during two or more academic sessions taken together;

(c)       the post on which the lecturer concerned is working is duly sanctioned by the competent authority or where the question of sanction of the post is under considered of Govt. in the Education Department;

N.B.�If the question of creation of post has been by the University and has been under the consideration of Education Department, such persons will be entitled to regularization, if the posts held by them are subsequently sanctioned by the Education Department.

(d)       the post/posts on which he has completed or will complete 24 months of service on 31.12.1980 was/were duly sanctioned;

(e)       before completing 24 months of the service on 31-12-80 his appointment has been made in any University Deptt./Constituent college/Affiliated College against a duly sanctioned post and on the basis of

(i)       advertisement in Indian Nation, Searchlight, Aryavarta Pradeep or in a leading daily news-papers of India, and

(ii)      from a panel recommended by a Selection Committee constituted by the University/College for the purpose, assisted by an expert or experts.

(f)        he possesses the qualifications for the post of lecturer as prescribed in the Statutes at the time of his first appointment;

(g)       his work has been found to be satisfactory; and

(h)       that the Chancellor, on the recommendation of a Committee constituted by him consisting of (i) the Vice-Chancellor/the Pro-Vice Chancellor of the University (ii) an officer nominated by the State Govt, and (iii) two experts nominated by the Chancellor, is satisfied that he fulfils the conditions laid down above:

Provided that the Chancellor, may in the case of individual hardship in respect of any teacher appointed at the time of the starting of the college against the first post in the department, relax any of the conditions prescribed in clause (e) above.

N.B.�The conditions prescribed under clause(e) above shall be deemed to be fulfilled even if the name of the lecturer concerned had ever been recommended by the Bihar Public/University Service Commission for appointment to the post of a lecturer or if at least one of his appointments as lecturer had been made on the basis of advertisement and selection as required above.

2. The Committee constituted under Sub-Clause (h) above shall meet from time to time on such dates as may be fixed by the Vice-Chancellor and finalise its recommendation in respect of all purely temporary lecturers within a period of four months from the date of implementation of these criteria.

3. The Registrar, shall, as early as possible, prepare a statement of
all temporary lecturers in the service of the University who fulfil the prescribed
conditions for consideration by the Committee. In case of admitted colleges the Principal
of the college concerned shall prepare a statement in respect of the temporary
lecturers of his college and send the same along with all the relevant papers
to the Registrar for consideration by the Committee. The recommendation of the

Committee shall be submitted to the Chancellor for his approval.

4. Lecturers absorbed in tho regular service under the above provision shall draw their first increment in the prescribed scale on the date of absorption or on Ist January, 1981 whichever is earlier and they shall draw the next increment after completion of one year service from that date.

5. The seniority of lecturers absorbed in regular service under the above provision shall be determined from the dates of their absorption which shall be so fixed that their inter se seniority, as it existed before their absorption in the service of the University or the college, as the case may be remains unaffected.

6. Hence forth the University shall not make any appointment of lecturer or of any other category of teacher without the recommendation of the University Selection Committee.

7. These criteria shall not be applicable to the temporary lecturers appointed on or after 1st January, 1979.

8. Notwithstanding anything contained above, purely temporary lecturers who completed 18 months of actual service on 30.6.1977 and were on the post on 19.11.1977, shall b� absorbed in the regular service of the University or the college concerned if the Chancellor is satisfied that they fulfil the conditions prescribed under the Statutes regarding regularisation or service of purely temporary lecturers in force immediately before the implementation of these criteria.
