Sub:- Regarding prior approval for running Vocational Courses in University and Colleges or enrolling students in such courses.
I am directed to invite a reference to the subject noted above. It is to inform that instances have come to the notice of Hon’ble Chancellor wherein Universities of Bihar are introducing and conducting various new courses without Hon’ble Chancellor’s approval/assent. At times this is done in anticipation of assent and the concerned Ordinance and Regulations are sent to Chancellor’s Secretarial for post-facto approval. This is against the provisions of Bihar State Universities Act. 1976, as amended upto date, and also a serious violation of directions issued vide this Secretariat’s letter no. BSU-32/2013-1211/GS(I), dated 21.08.2015. (Copy enclosed)
Therefore, Honb’le Chancellor after due consideration of the matter has been pleased to direct the Universities of Bihar to comply with the following instructions:-
1. No new course shall be started henceforth by the Universities without the clear approval of Chancellor and State Govt. (for number of seats). Courses cannot in all cases be started in anticipation of assent.
2. All such courses which do not have Chancellor’s approval or all courses which have been rejected, or objected to for some reason or the other, shall not be allowed to be conducted till further clarification and subsequent approval of Hon’ble Chancellor.
3. Regular, vocational, self financed courses or courses under Distance Learning, that do not have approval/permission/affiliation from UGC/State Govt./DEB/Regulatory Bodies of University, whichever is applicable, will not be conducted in any of the Universities of Bihar.

4. No course/subject for which there is no eligible faculty as per UGC guidelines at the University level shall be introduced or allowed to be conducted.
5. No Study Centre under Distance Learning Directorate can be opened or allowed to operate beyond the territorial jurisdiction of the concerned University as per Section 3 of Bihar State Universities Act 1976. All such study centres that have been opened in violation are directed to be closed down with immediate effect.
6. Approval/permission for specific number of seats and fee structure of any such course mentioned above, is a subject under the jurisdiction of HRD. Govt. of Bihar or the concerned Regulatory authority Govt. of India, such as NCTE, AICTE, MCI etc. As such, no University has the authority to exercise its own discretion in this matter.
7. Higher Education Institutions, funded & aided in particular by the state Govt. cannot be allowed to become commercial centres, harming the interest of student community.
8. Universities are directed to be punctual in sending compliance report to the Chancellor Secretarial, and respond to the queries within time limit. Slackness or non compliance at the level of University will be viewed adversely and invite action against the concerned.
9. Degrees/Certificates of any courses which was conducted without approval of Hon’ble Chancellor or the competent authority, shall not be recognized and the concerned University authorities shall be held solely responsible for the consequences. Disciplinary action shall be initiated against those responsible.
10. Universities are further directed to display on their notice-board and websites a factual list of approved courses citing full details of the communications of cpmpetent authority.
Further, Universities will publish in prominent daily new papers that students, taking admission on other than the duly approved courses, will be doing so at their own risk.
11. Reports sought by the Chancellor’s Secretariat, must be sent by the respective Universities with complete facts & specific information/data. Vague and elusive answers, such as “as per rules” or “in process” etc. will not be accepted or viewed favourably.
Therefore, violation of Hon’ble Chancellor’s direction, as mentioned above, at any stage, shall be taken seriously, and disciplinary proceeding shall be intimated against those responsible.
Further necessary action may kindly be taken accordingly.
