61. Statute governing the procedure to be followed for the appointment of Vice-Chancellor, Aryabhatta Knowledge University, Patna (Memo no. AKU-02/2014-1375-GS(1) dated 16.9.2014)

The Hon'ble Chancellor, after due consideration of the Draft Statutes governing the procedure to be followed for the appointment of Vice Chancellor. Aryabhatta Knowledge University, Patna. submitted by the Aryabhatta Knowledge University, Patna, the opinion of the State Govt. on the Draft Statutes and in exercise of the powers vested under Section 28 of Aryabhatta Knowledge University Act, 2008, as amended upto date, has been, pleased to approve the Statutes governing the procedure to be followed for the appointment of Vice Chancellor, Aryabhatta Knowledge University, Patna

l.a. Short title and Commenement.—(i) These Statutes may be called "The Statutes governing the procedure to be followed for the appointment of Vice-Chancellor of the Aryabhatta Knowledge University, Patna, in short the University, under the Aryabhatta Knowledge University Act, 2008, in short the Act.

ii. These Statutes shall come into force with effect from the date of assent of the Chancellor.

b Extent of Application.—These Statutes shall be applicable for the appointment of Vice-Chancellor of University under the Act.

c. Right to interpret.—The chancellor of the University under the Act shall have the right of interpretation of these Statutes.

d. Power to amend and repeal the Statutes.—The Statutes may be amended from time to time or repealed as provided in the Act.

e. Power to Remove Difficulties.—lf any difficulty arises in giving effect to these Statutes, the Chancellor may, by order, make such provisions not inconsistent with the provisions of the Act and these Statutes as may appear to be necessary for removing the difficulties.

2. Definition.-—The Definitions given in the Act shall hold good for the purpose of these Statutes and these Statutes, unless the context otherwise requires—

(a)   "Act" means the Aryabhatta Knowledge University Act, 2008, as amended from time to time.

(b) "Annexure" means annexure appended to these statute

(c)   "Government" means Government of Bihar.

(d) "Institution" means the Institutions in the field of Science, Medical/ Dental Science.   Technology, Management or any other relevant fields.

(e)   "Nodal Officer means a person who is either serving or retired or specially engaged for this purpose and who is holding or has held a post not below the rank of Deputy Secretary to the Government of Bihar; and who had been so designated by Secretary to coordinate the activities related to the appointment of Vice-Chancellor of the University under the Act.

(f) "Reputed persons" means serving or retired Heads of institutions of national or international repute like Indian Institute of 'Technology, Indian Institute of Science, Indian Institute of Management, Indian Space Research Organisation, Vice-Chancellors of Central or State Universities or recipients of such national or international awards as are instituted by reputed national or international bodies for contributions to relevant fields of study.

(g) "Secretary" means the Principal Secretary/Secretary to the Governor cum-Chancellor for the University under the Act.

(h) "University" means the University, established under the Act.

3. The Constitution of Committee.—(a) The process of preparing a panel shall begin at least three months before probable date of occurrence of the vacancy of Vice-Chancellor and shall be completed within the time limit fixed by the Chancellor. The Chancellor, however, may extend such time limit if in the exigency of the circumstances, it is necessary to do so.

Provided that the period so extended shall not exceed two months in the aggregate.

(b) The Chancellor shall constitute a Committee for the University as per the provisions made in sub-section (3) of Section 10 of the Act.

4. Budgetary Provision.—-The Budgetary provisions for this process shall be made in the Budget of the Governor's Secretariat.

5. Qualifications and experience for Vice-Chancellor.—(a) The academic qualifications and experience for the post of Vice-Chancellor shall be as laid down in sub-section (1) of Section 10 of the Act.

(b) In addition, the Candidate may have the following desirable qualification:

(i)        At least 10 yrs. experience as professor in relevant fields.

(ii)       Five research publications in peer-reviewed/referred international research
journals after Ph.D. and/or publication of quality books in the

field of Science, Medical/Dental Science, Technology. Management or any other relevant field, referred for study in higher education at the national/international level;

(iii)       Execution of one major research project in the field of science, Medical/ Dental Science, Technology, Management or any other relevant field.

(iv)       Experience of working with international bodies or international exposure through participation in workshops, seminars, conferences held within or outside India;

(v)        Experience of organizing events such as workshops, seminars, conferences at international level within or outside India in the field of Science, Medical/Dental Science, Technology, Management or any other relevant field.

(vi)       Five years experience of managing institutions of repute within or outside India.

6. Committee Secretariat.—(a) The office of the Committee shall be in the Governor-cum-Chancellor's Secretariat.

(b) The Nodal Officer shall be responsible for coordinating the activities related to the appointment of Vice-Chancellor of the University and shall directly work under the direction of the Secretary.

(c) The member of the Committee, nominated by the Government, shall convene the meeting of the Committee on the direction of the Chancellor and the Nodal Officer shall place all Applications/Nominations received in response to the advertisement before the Committee

(d) The Nodal Officer shall be the custodian of all the documents and records and will hand over these documents and records in sealed cover to the Secretary after the selection process of Vice-Chancellor is over.

(e) The Nodal Officer shall be provided with suitable assistance of office staff and equipments for managing the appointment related works.

7. The Functioning of the Committee.—The Committee in the process of Identifying suitable persons for the post of Vice-Chancellor shall be required to assign due weightage to the qualification, teaching experience, research publications, research projects completed/ongoing, book(s) authored and collaborativee skills and experience of managing institutions.

8. Procedure of Modality to be followed by the Committee.—(a) The Applications and Nominations for the post of Vice-Chancellor shall be invited through advertisement published in at least two national dailies and on the websites of the Governor-cum-Chancellors Secretariat and of the University, The applications shall be invited in the name of Nodal officer though soft and hard copies in prescribed format (Annexure-I ) within stipulated time limit.

(b) A reputed person or institution may nominate/sponsor suitable candidate for the post of Vice-Chancellor in the prescribed format (Annexure-Il) within the stipulated time limit. In case of Nomination the nominating person or institution shall append or short, reasoned recommendation about the Candidate being nominated/sponsored by the reputed person/institution and will also certify that the consent of the Candidate has been taken for such Nomination/Sponsor.

(c) After the identification process, the short-listing of Candidates would be done by the Committee.

(d) The committee may invite short listed Candidates with higher merit for presentation and interaction in Patna at their own cost.

            (e)       The Committee, after Candidate's presentation and interaction, shall prepare a panel of 3 to 5 names arranged in alphabetical order.

            9.         Recommendation of the Committee.-(a) The names and relevant details of the Candidates, who are included in the panel for the post of Vice-Chancellor, shall be submitted by the Governor in a sealed cove, forwarded by the Government, to the Chancellor.

            (b) The Committee while recommending the panel shall give a detailed write up on the suitability of each Candidate in the panel for the post of Vice-Chancellor.

            (c) the report shall be signed by all the members of the Committee.

            (d) in absence of unanimous decision the opinion of majority of the member shall prevail.

            10. Appointment of Vice-Chancellor.-The Chancellor shall appoint suitable Candidate as the Vice-Chancellor based on the panel recommended by the Committee and forwarded by the Government.
