45. Statutes regarding Mode of appointment of Teachers of the University (for Patna University only vide section 30 (f) of Patna University Act, 1961)

(Assented to by the Chancellor on the 30th of November, 1962, vide Memo. No. PU-306/62-388-GS (i). dated the 31st of January, 1963.)

(1) Whenever an appointment to the Superior post of a teacher in the University is to be made either due to a vacancy or on account of the creation of a new post, the Registrar shall report the same to the Vice-Chancellor.

(2) The posts of University Professors shall not be filled up by promotion of teachers in the University, but only by open advertisment through the Bihar Public Service Commission, save where in exceptional cases, the Vice-Chancellor decides with the approval of the Chancellor that the post be filled up by negotiation.

(3) The posts of Professors and/or Readers and Principals shall be filled up ordinarily by promotion, but in cases where sufficient number of suitable persons are not available for promotion, the post shall be advertised through the Public Service Commission.

(4) Before taking a decision whether the posts of Professors and/or Readers and Principals are to be filled up by promotion or by direct recruitment, the Vice-Chancellor in consultation with the Dean of the Faculty concerned and such other experts from amongst the teachers of the University as he deems but shall determine in any further specialised qualifications in addition to those prescribed in the Statutes should be laid down for the particular post; and in deciding whether the post is to be filled up by promotion or by direct recruitment the requirement of such further specialised qualifications, if any, shall be kept in view.

(5) After it has been decided whether the post in question is to be filled by promotion or by direct recruitment, the procedure for making the appointment as laid down in the Patna University Act, 1961, shall be followed.

(6) When making a reference to the Public Service Commission, all the qualifications required for the post and other necessary details shall be forwarded to the Commission.

In case the appointment is to be made by promotion, the Syndicate shall send to
the Commission the names of all teachers eligible for such promotion in order of
seniority accompanied by all papers relating to them including statement of qualifications, teaching, research and administrative experience, made by the teachers concerned themselves, in order to enable the Commission to consider whether the person recommended by it have the requisite character and ability for the post, and in such case out of two names recommended by
the Commission in pursuance of Section 26(3) of the Act, the Syndicate shall make its selection for

appointment.

(7) Whenever the Syndicate does not appoint the first nominee of the Bihar Public Service Commission to any particular post, it shall record its reasons for doing so and the same shall be forwarded to Chancellor for his information.

(8) If it has been decided by the Vice-Chancellor with the approval of the Chancellor that a particular post of University Professor should be filled up by negotiation, the name of the person selected by him shall be placed before the Syndicate for approval of his appointment and if the Syndicate decides to appoint him, his name shall be sent to the Bihar Public Service Commission along with a statement of his qualifications and teaching and research experience, etc. for their concurrence.

(9) The Syndicate may, subject to the provision of Statutes regarding creation of posts, on the recommendation of the Vice-Chancellor appoint any person as—

 (a) Visiting Professor on such terms as may be settled by it, and

(b) Honorary teacher, for a particular period of time in one session as it may think fit.

(10) Notwithstanding anything contained in the Statutes the Vice-Chancellor in exceptional cases in the interest of the University, may recommend to the Syndicate to invite a distinguished person of outstanding merits and eminent qualifications to deliver special lectures and guide research in the University, and the Syndicate may, in such a case, accept the recommendation of the Vice-Chancellor on such terms and for such period as it may determine.

(11) ) The Chancellor may, on the recommendation of the Academic Council and the Syndicate, confer the designation of Emeritus Professor on such retired Professor of the University as may have rendered meritorious and distinguished service.
