l. Under the statutes referred to above, which come into force from 1.4.72
three alternative schemes, viz. General Provident
Fund-cum-Pension-cum-Gratuity Scheme, Contributory Provident Fund-cum-Gratuity
Scheme and Contributory Provident Fund scheme will be available for option by
the Patna University employees who entered Patna University service before
1.4.78. and had not ceased to be in that University�s service before 1.4.72.
Those who joined Patna University service on or after 1.4.78 will be governed
only by the G.P.Fund-cum-pension-cum-Gratuity scheme. The eligible employees
should exercise their option as provided for in the Retirement Benefit Statutes.
Those who do not exercise any option or in whose case the option is not received
in time will be deemed to have opted for the G.P Fund-cum- Pension-cum-Gratuity
Scheme.
2. Those who opt or are deemed to have opted for the General Provident
Fun-cum-Pension-cum-Grautity Scheme or to whom this scheme is authomatically
applicable, will inform in writing to the Registrar of the University/concerned
Principals of the constituent colleges (in the case of non-teaching staff), the
rate at which they will like to contribute to the G.P.Fund. Till this
information is received. The G.P.Fund subscription will be recovered on the same
rate at which the employee is contributing to the G.P.Fund. The rate of
subscription will not be less than 6.25% and not more than the maximum of their
emoluments. The rate of subscription will be in whole rupees; 50 paise and above
to be rounded off to the next higher rupee. The subscribers to the Fund will be
entitled to vary the rate of subscription once-only during a financial year.
3. The above intimations will be received in the Provident Fund Section of
the University. That Section will see that the rate of subscription is in
accordance with the provisions of the Statutes. Thereafter a General Provident
Fund Account Number will be allotted to each subscriber and intimated to the
subscriber/Principal of the concerned college in the case of non-teaching staff,
for quoting it in
all future salary bills in which contribution towards G.P. Fund are made. The

dent Fund Section will also have the rate of subscription noted by the
Salary paying Section in the case of the self drawing stall.
4. The self drawing staff will enclose to their salary bills a schedule in
tripli-
cate, in the proforma enclosed at Annexure-l indicating their Fund Account
Number, the amount deducted in the salary bill on account of subscription to the
Fund and/or the refund of Advance, if any. In the case of non-teaching staff,
this schedule will be prepared by the authority drawing their salary bill.
5. On receipt of the scheduled with the salary bills, the salary paying
section, will keep one copy of the schedule with the salary bill and pass on the
other two copies to the Provident Fund Section indicating the number and date of
the cheque and its amount/the number and date of the advice and its amount,
through which the amount involved has been remitted to the Bank.
6. A separate account known as "Patna University Employees General
Provident Fund Account" in the name of each subscriber will be opened with any
of the scheduled banks at Patna, as may be decided by the Vice-Chancellor. These
accounts will be operated by the Registrar or such other officer(s), as may be
authorised by the Vice-Chancellor. The subscriptions made by the employees will
be remitted by the Salary Paying Section to the Bank concerned, as and when the
salary bills are paid. By the 15th of each month, the Provident Fund Section
forward the Bank pass books of all the subscribers to the Bank, for posting to
the credit of the subscribers, the deductions made from their pay on account of
G.P.Fund upto the end of the preceding calendar month.
7. The Provident Fund Section will also maintain the General Provident
Fund Account of each subscriber in the proforma enclosed at Annexure-ll. This
account will be posted from the schedules received from the salary paying
section. The amount of interest earned by the subscribers will be noted by the
Provident Fund Section from the credit given by the Bank on that account in
their passbooks. At the end of every month, the Provident Fund Section will
prepare an abstract of the General Provident Fund Account which will show the
opening balance, the credits (subscription) received during the month, the
payment (advances and withdrawals) made from the Fund during the month and the
net closing balance. This section will periodically compare the entries in the
Bank Pass Books with the account maintained by them, and set right in
consultation with the Bank, if necessary, any discrepancies found between the
two.
8. If any subscriber desires to invest any part of his balance in the Fund
in National Savings Certificate, G.P. Notes or Fixed Deposits in any
Nationalised Bank or other approved Trustee Samities, his application for
purchase of such certificates etc. will be examined by the Provident Fund
Section and if found in order, approval of the Vice-Chancellor thereto will be
obtained and thereafter the Bank be requested
over the signature of the officer operating the account, to invest the money as
requested by the subscriber. These certificates etc. on receipt from the Bank
will be kept under the custody of the Registrar, who may entrust them to the
Officer-in-charge of the Provident Fund Section. A record of

these certificates will be kept in a register in the form at Annexure-III,
and a physical stock taking of these will be done in the month of January each
year to verify that all the certificates etc. are in existence. A record of this
verification will be kept in this register over the signature of the Registrar.
The interest earned on these investments will be deposited in the Provident Fund
Account of the subscriber and shown in a separate column in his General
Provident Fund maintained by the P.F. Section.
If a subscriber so desires, he/she may be allowed to draw money from her
Provident Fund to pay premium of his/her Life Insurance Police (ies.), vided
that the policy/policies is/are assigned to the Registrar of the University Such
policies will be kept in the safe custody of the Registrar and their record kept
in the register in the form at Annexure III.
9. The Provident Fund Section will also keep a record of nominations
received from the subscribers. In the month of June every year, the Subscriber
be furnished a stater. ant of their account up to the end of the
preceding financial year and also requested to send nomination forms if not
already furnished fresh nominations, if they so desire.
10. Applications for advances and withdrawals from the Fund will be
received in the Provident Fund Section. That Section will verify the credit
balance lying to the credit of the subscriber, as also the balance of any
previous advance(s). It will also verify if any previous withdrawal was made by
the subscriber on the same account The particulars about the salary and length
of service in the case of self drawing officers will be got verified from the
salary paying section. In the case of others, this verification will be done by
the Heads of institution/administrative section concerned Thereafter, that
Section, will submit the application for advance/withdrawal for orders of the
Vice-Chancellor. After the advance/withdrawal is approved by the Vice-
Chancellor, the Provident Fund Section will pay the amount to the employee under
intimation to the Head of the institution where serving in the case of non-self
drawing persons and also Salary Paying Section; in case of advances only. A note
of these payments will also be kept by the Provident Fund Section, in the
Provident Fund Account ledger of the concerned employee. The repayment of the
advance will be watched by the salary paying section and the Head of the
Institution/office the case of non-teaching staff. The Provident Fund Section
will also watch that the recoveries of the advance are regularly effected till
its liquidation.
11. The accounts of subscribers who retire or die will be closed on their
retirement/death. On receipt of applications for final withdrawal in the case of
subscribers who retire and are alive, the Provident.Fund Account will be closed
after obtaining the approval of the Vice-Chancellor and the amounts released to
the subscriber. The certificate (s) etc. if any, will also be released in favour
of the employee and handed over to him.
In case of death of a subscriber, either before retirement or after
retirement but before release of his/her deposits in the Fund, the Provident
Fund Account will be closed and after obtaining the approval of the
Vice-Chancellor, the

amount due will be released to his/her nominee/nominees, as the case may
be, on the basis of the latest Nomination made by the deceased on record in the
Provident Fund Section. Tho certificate(s). if any, will also be similarly
released for payment of the amount(s) duo to the nominee/nominees, as the case
may be, If there is no nominee, the amount will be released in accordance with
the provisions of the Statute.
12. As the scheme comes into force with retrospective effect from 1.4.72,
the subscriptions already made by the employees, (who opt for G.P.
Fund-cum-Pension-cum-Gratuity Scheme), to their G.P.Fund will be transferred to
their G.P.Fund accounts along with interest earned thereon. The employer's share
of the contribution with interest thereon will be transferred to the Pension and
Gratuity Fund. In case of those who have retired and opt for General Provident
Fund-cum-Pension-cum-Gratuity Scheme, only the employer's share (plus interest
thereon) of the G.P.Fund will be transferred to Pension and Gratuity Fund. Their
own contribution plus interest there on will be payable to them. In case an
employee has already received final payment of his G.P. Fund accumulation, the
employer's share of the contribution (plus interest thereon) shall be deposited
by him either in cash or by adjustment from the amount of gratuity or both.
13. In the event of transfer of an employee from one University to
another, within Bihar, his/her G.P.Fund Account will be brought up to date and
the amount standing to his/her credit along with interest earned will be
transferred to the University whereto he/she is transferred.
CHAPTER-II
PENSION AND GRATUITY FUND
1. The University will have a Pension and Gratuity Fund known as "Patna
University Employees' Pension and Gratuity Fund." The following amounts will be
credited to this Fund:-
(i) Employer's share (plus
interest thereon) of the contributions made to the G.P.Fund account of
employees, who joined service on or after 1.4.78 and of employees' who joined
service before that date and have opted for the G.P.
Fund-cum-Pension-cum-Gratuity scheme.
(ii) Employer's share (plus interest
thereon) of the contributions made to the G.P.Fund to the extent of 2% of the
emoluments of such of the employees who joined service, before 1.4.78 but have
opted for the G.P. Fund-cum-Gratuity Scheme.
(iii) Contributions received from the State
Government from time to time for the purpose.
2. The Pension and Gratuity Section will give to the Budget Section for
inclusion in the Annual Budget Estimates, the requirement of funds needed for
meeting the pension and gratuity liability during the next financial year
3. The account for the Fund will be maintained in one of the scheduled
banks at Patna, as may be decided by the Vice-Chancellor. This F�nd will be

operated by the Registrar and/or such other officer(s) as may authorised
by the Vice-Chancellor.
4. This Fund will be utilised for payment of pensions including commuted
value of pensions, family pensions and gratuities to the employees of the
University or their beneficiaries, eligible to these benefits, as the case may
be. These payments will be authorised through pension payment orders in the form
enclosed at Annexure IV which will be signed by the Budget and Account Officer
and the Finance Officer, The Registrar will also sign the Pension Payment order,
where payment of an amount exceeding Rs. 5000/- is involved.
5. The employees (or their beneficiaries in the case of family pension)
will draw their pension as also commuted value of pension and gratuity, as the
case may be, from the Bank on which the Pension Payment Order is issued, For
this purpose, the employees or their beneficiaries, as the case may be, will be
required to open single account in his/her name, with the Branch of the Bank
from where they want to draw the pension/gratuity. While commuted value of
pension and/or gratuity will be paid in one lump sum, pension will be credited
by the Bank in the employees'/beneficiaries account monthly in arrears. The Bank
will debit all these payments to the Pension and Gratuity Fund of the University
and send a monthly account thereof duly supported by scrolls of disbursements
made, which will quote in each case, the number and date of the Pension Payment
Order on the authority of which the payment is made. The Bank will also indicate
the credits received and the balance available in the Fund at the end of every
month. These figures will be checked in the Pension and Gratuity Section of the
University and a report about the position of the balance in the Fund submitted
to the Vice-Chancellor every month. Depending on the quantum of the balance,
anticipated receipts and expenditure, the Vice-Chancellor may decide to invest a
portion of the amount lying in the Fund in short or long term deposits with the
Bank.
6. The Heads of Institutions in the case of non-teaching staff serving in
Colleges/Departments/lnstitutions and the Registrar, in all other cases will
draw up a list of persons due for superannuation during the next financial year
by the 1st of August each year. These lists will be drawn in three parts-one of
those who have opted for G.P. Fund-cum-Pension-cum-Gratuity Scheme, another of
those who have opted only for G.P.Fund-cum-Graiuity Scheme, and the third of
those who have opted only for G.P.Fund Scheme. The list of those persons who
have opted for G.P.Fund-cum-Pension-cum-Gratuity Scheme as also of those who
have opted for G.P.Fund-cum-Gratuity Scheme, will be sent to the Pension and
Gratuity Section, for their information. These lists will indicate the length of
service these individuals will have on the date of their retirement and the rate
of emoluments reckonable for pension they will be drawing during the last ten
months of their service. A copy of these lists and the list of persons who have
opted for G.P.Fund Scheme, will also be sent to the P.F.Section, for their
information. In the case of teaching staff, a copy of the list will be sent by
the Registrar to the Heads of Institutions, where they are serving.

7. At least six months before the date ot retirement on superannuation of
an employee, the Head of the Institution and the Registrar in the case of
employees in the University Office will initiat the proposal for grant of
pension and gratuity in tho case of persons who have opted for
G.P.Fund-cum-Pension-cum-Gratuity Scheme and gratuity only in the case of those
who havo opted for G.P.Fund-cum-Gratuity Scheme. An application in the form
enclosed at Annexure-V will be prepared by the Head of the Institution/Registrar
for this purpose.These applications will bo accompanied by two slips on quarter
sheet of paper bearing specimen signatures of the applicant and of his/her
wife/husband and two joint photographs of husband-wife, both duly attested by a
gazetted officer or an officer of the University. in the case of Pardanasheen
ladies, joint photographs may not be furnished along with the application.
In such case thumb and finger impressions or specimen signatures in the case of
those who are literate, and particulars of height and personal marks, shall be
required to be furnished in duplicate on two separate sheets, duly attested by a
gazetted officer or an officer of the University or Head of the Institution. Tho
applicants shall also furnish thumb and finger impressions or specimen
signatures (if literate) and personal marks of their spouses, in duplicate on
two separate sheets duly attested by a gazetted officer or an officer of the
University or Head of the Insitutions.
In addition to the above, the following certificate shall be obtained from
the employee and enclosed to the application.
"l hereby declare that I have neither applied for nor received any pension
or gratuity in respect of any portion of the service included in this
application and in respect of which pension or gratuity is claimed herein nor
shall I submit an application hereinafter without quoting a reference to this
application and to the orders which may be passed thereon."
8. After completion of the application as above, the Head of the
Institution where the employee is serving and the Registrar in the case of
employees serving in the University office will forward the application along
with the service record of the employee, to the Pension and Gratuity section.
That section will check the application with the service record of the employee
concerned to verify the length of service in all cases and also the rate of
emoluments in the case of non-teaching staff serving in
Colleges/Departments/lnstitutions. If need be, the pay bills for such staff will
be obtained for verification from the Colleges/Departments/lnstitutions. The
rate of emoluments in other cases, will be got verified from the salary paying
section. Thereafter, the proposed rates of pension and gratuity will be checked
and the Pension application put up to the Vice-Chancellor, stating specifically
the amount of pension/gratuity admissible to the applicant under the rules.
9. On receipt of order of the Vice-Chancellor as above, the
Pension/Gratuity Section will ask the applicant to furnish No-demand Certificate
from the various Departments concerned if not already received. When these are
received a pension payment order in the form enclosed at Annexure IV as the case
may
be, will be issued by the Pension and Gratuity Section authorising payment of

sion and/or Gratuity as approved by the Vice-Chancellor.
The payment of pension will commence from the first of the 2nd month
following the date of the employee's retirement, i.e. a person retiring on 31 st
March will be paid his first pension for the month of April, on first of May.
The amount of gratuity will, however, be payable immediately after retirement.
10. If due to any reason, verification of the records of any employee who
has retired and has applied for payment of the pension, gratuity etc. due to
him, is delayed beyond one month of the date of retirement of the employee,
provisional pension will be paid to the employee to the extent of 90 per cent of
the expected pension due to be paid to the employee, and this provisional
pension shall start being paid to the retired employee not later than from the
second month of the date of retirement of the employee:
Provided further that if the verification etc. of records is not completed
even after one month of the date of retirement of the employee, and the pension
of the retired employee is not determined on that account for a period of ten
months from tho date of retirement of the employee, the provisional pension to
the extent of 90% of the expected pension as being paid under para above, shall
be suitably raised to 100% of the expected pension, and be finally regarded as
the pension to which the employee shall be entitled.
11. The Pension and Gratuity Section, will forward to the Bank with whom
the Pension and Gratuity Fund is maintained, the original copy of the Pension
Payment Order, an attested copy of the employee's and his spo�se's signatures,
as well as an attested copy of the joint photograph of the employee and his/her
wife/husband, as the case may be (in the case of Pardanasheen ladies, personal
marks will be sent instead of the joint photograph). The following seal will be
embossed on the original copy of the P.P.O.

12. An additional copy (without embossing of the seal mentioned above) of
the P.P.O. will be supplied to the Bank, if the employee has chosen to draw his
pension/gratuity from a branch of the Bank, other than the one at which the Fund
Account is maintained. In such a case, the bank will keep this copy of the
P.P.O. for its record and send the original P.P.O. with the attested copy of the
signatures and joint photograph (and personal marks in the case of Pardanasheen
ladies) to its branch wherefrom the applicant has desired to draw the
pension/gratuity.
13. The applicant will present himself/herself for first payment of
pension/ gratuity to the concerned branch of the Bank who, on verification of
his/her signature and photograph, (personal marks in the case of Pardanasheen
ladies) credit the amount of his/her individual account maintained with it.
14. The branch of the bank, with whom the account of the Fund is
maintained will furnish by the 15th of every month, statement of
pension/gratuity paid during the preceding month. This statement will be
prepared branchwise and will

indicate the date of each payment, the name of the pensioner, the number
and date of the relevant P.P.O. and the amount paid,
15. The Bank will also furnish to the University, life certificate of the
emloyee twice annually, once in May and next in November each year in the form
given in Annexure-VIII". These scrolls will be received in the Pension and
Gratuity Section, where these will be checked to verify that payments made by
the Bank are in order.
16. The Pension and Gratuity Section will maintain the account of the
Pension and Gratuity Fund in a ledger form. On the credit side (left hand side)
will be entered all receipts to the Fund including interest on investments made
from the Fund with the Bank, and on the debit side (right hand side) all
payments made therefrom, as reported by the Bank and found to be correct on
check by the pension and Gratuity Section. The ledger will be closed monthly and
balance in the Fund brought out. The Bank Pass book for this Fund will be got
completed by the Bank every month and reconciled with the ledger. Any
discrepancies found between the ledger and the Bank Pass Book will be reconciled
promptly.
17. Before issuing a P.P.O., the Pension and Gratuity Section will ensure
that funds to meet the expenditure are available in the Pension and Gratuity
Fund. For this purpose, that Section will take into account the balance of the
Fund lying in the Bank Account, interest receivable on the investments made from
the Fund and contributions due from the Government for credit to this Account.
18. A record of each P.P.O. issued, will be maintained by the Pension and
Gratuity Section in a P.P.O. numbering register. Each P.P.O. will bear a serial
number starting with number one. Thus the first P.P.O. will be allotted number
as "Patna University P.P.O. No. 1". In this register the number allotted to the
P.P.O., the person in whose favour it is issued, the amount of pension/gratuity
payable, the period for which pension is payable, the number and date of any
earlier P.P.O. superseded/modified, and the date of its issue, will be noted by
the Pension and Gratuity Section.
19. The P.P.O. embossing seal will be kept in the personal custody of the
officer-in-charge of the Pension and Gratuity Section. The embossing of the
P.P.O.with this seal, will be done in his presence so as to ensure that it is
not misused.
20. On the death of a pensioner, the family pension will be paid by the
Bank to his/her wife/husband at the rate already mentioned in the P.P.O. issued
in favour of the deceased pensioner. The fatmily pension will be payable from
the date following that of death of the pensioner, as indicated in the death
certificate produced by the pensioner's wife/husband. The Bank will verify the
identity of the claimant for family pension from the specimen signatures and
joint photograph already forwarded with the deceased pensioner's P.P.O. The
claimant for family pension shall open a separate individual account with the
Bank (if such an account does not already exist) for credit of the family
pension and the arrears, if any, on the deceased pensioner's pension upto the
date of his/her death. A copy of the death certificate will be forwarded by the
Bank to the Pension and Gratuity Sec-

tion alongwith the scroll of the month, in which family pension is paid.
The Pension and Gratuity Section will keep a note of the date of death of the
pensioner and issue of family pension on the office copy of the P.P.O. of the
deceased Pensioner and the P.P.O. register.
21. Where a receipient of family pension is a widow/widower it will be
payable to her/him till the date of death or remarriage, whichever is earlier.
On the occurrence of any of these events or in a case where the pensioner is not
survived by a widow/widower, the pension will be payable in the case of minor
son, till the age of 18 years and in the case of unmarried daughter, till she
attains the age of 21 years or marries. The family pension in these cases will
be sanctioned to the minor children through their natural guardian till the
youngest child attains the age of maturity. In disputed cases, payments will be
made through a legal guardian. The natural guardian in the case of Hindus,
Budhists, Jains, Sikhs and Christians is the father and after him, the mother,
and in the case of Mohammadans, the father. The natural guardian or if there is
no natural guardian, the legal guardian will apply for grant of family pension
in the form at Anxexure VI on behalf of the minor children with two copies of
his/her photograph, duly attested by a gazetted officer or an officer of the
University. Applications for grant of family pension and gratuity in the case of
employees who dies while in service will also be submitted on this form. These
applications, after verification with the details of family members of the
deceased furnished by him vide Rule 26 of Appendix-'A' of the Statutes, length
of his/her qualifying service and rate of pay last drawn, will be put up to the
Vice-Chancellor for sanction of pension/gratuity to the family of the deceased.
The award of pension/gratuity in these cases, will be notified through P.P.O.s,
as in other cases.
22. Applications for grant of invalid pension will be supported by a
medical certificate of incapacity for service from the Medical Board constituted
by the Vice-Chancellor, in the following form:
"Certified that we have carefully examined AB...............son/daughter
of CD.........................appointed as...........................in this
University. His/her age by his/her own statement is... ................years and
by appearance about ���......years. We consider him/her to be completely and
permanently incapacitated for further service of any kind in consequence of
....(here state disease or cause). His/her incapacity does not appear to us to
have been caused by irregular or intemperate habits.

23. Commutations of Pension.�Applications for commutation of pension will
be submitted by the employees in the form enclosed as Annexure-Vll. These

applications will be examined in the Pension and Gratuity Section and Part
placed before the Syndicate for orders. If it is decided by the Syndicate or
provisionally by the Syndicate or provisionally by the Vice-Chancellor to
sanction the commutation applied for, the employee will be required to appear
before a Medical Board to be constituted by the Vice-Chancellor. Appearance
before the Medical Board will not be necessary where an employee who has retired
on superannuation pension applies for commutation of pension within one year of
his retirement. In such cases the commuted value of pension, will be paid on
acceptance of his application for commutation by the Syndicate.
(ii) The employee will be required to appear for medical examination
within three months of the date of the order.
(iii) An employee may withdraw his application for commutation or reduce
the amount of pension to be commuted within two weeks of receipt of the findings
of the Medical Board if the Medical Board decides that his/her age for the
purpose of commutations shall be assumed to be greater than his/her actual age.
If the employee does not withdraw in writing his/her application within the
period of two weeks, he/she shall be assumed to have accepted the recommendation
of the Medical Board.
(iv) The payment of the commutation money will be authorised through a
fresh P.P.O. issued on the Bank from whom the employee draws his/her pension.
The rate of pension will stand reduced from the date the commutation money is
paid to him/her. If the pensioner dies on or after the day following that on
which commutation becomes absolute but before receiving the commutation value,
this value shall be paid to his/her wife/husband and in case wife/husband is not
alive, this amount shall be payable to his/her heirs.
The commutation shall become absolute, that is, title to receive the
commuted portion of pension shall cease and title to receive the commuted value
shall accrue, in the case of unimpaired life, on the date on which the medical
authority signs the medical certificate; and in the case of an impaired life, on
the date of written acceptance of the commutation or the date on which the
option of withdrawing the application expires, whichever is earlier.
A commutation once applied for and sanctioned and given effect to, cannot
be rescinded i.e. the portion of a pension that is commuted cannot be restored
on refund of its capitalised value.
(v) Notwithstanding anything contained above, an employee may withdraw his
application for commutation of pension, at any time before the issue of the
commutation of P.P.O.
24. Subject to the provisions of the Retirement Benefit Statutes-
(a) the preceding rules will stand amended in event of any change (s) to
the corresponding provision(s) in the Bihar Pension Rules,
(b) the Bihar Pension Rules, will apply, as amended from time to time, in
all matters not covered by the preceding Rules so far as procedure regarding
grant/ payment of pension(s)/gratuity is concerned.

G.P.Fund
In case of employees who opt for Scheme 'B' (G.P.Fund-cum-Gratuity Scheme)
or Scheme "C" (G.P.Fund Scheme, the existing procedure/rules regarding Provident
